TERMS AND CONDITIONS OF SALE
The online store kiharhair.ee (hereinafter the Online Store) is operated by Kiharhair OÜ (registry code 16576512), located at Lehola 8, Tartu, Estonia.
Validity of the Sales Contract, Product, and Price Information
These terms and conditions apply to the purchase of goods from the Online Store.
Prices of the products sold in the Online Store are listed next to the products. Delivery charges will be added to the price. All prices in the Online Store are in euros.
The delivery fee depends on the buyer’s location and the delivery method. The applicable delivery fee is displayed to the buyer during the checkout process.
Information about the goods is provided directly next to each product in the Online Store.
Placing an Order
To order a product, the desired items must be added to the shopping cart. To complete the order, the required fields must be filled in and a suitable delivery method selected. The total amount due will then be displayed, which can be securely paid using the following payment methods:

NB! When paying via bank link, be sure to click the “Return to merchant” button after completing the payment in your bank.
Payments are mediated by Maksekeskus AS. Payment is made outside the Online Store in a secure environment—when paying by bank link, in the secure environment of the respective bank, and when paying by credit card, in the secure environment of Maksekeskus AS. The seller does not have access to the buyer’s banking or credit card data. The contract enters into force once the payment has been received in the Online Store's bank account.
The owner of the Online Store is the data controller and forwards the personal data necessary for processing payments to the authorized processor Maksekeskus AS.
If the ordered goods cannot be delivered due to the item being out of stock or for any other reason, the buyer will be notified at the earliest opportunity and the paid amount (including delivery costs) will be refunded immediately but no later than 14 days after the notification.
Delivery
Goods are shipped to the following countries:
Available delivery methods: Smartpost, DPD, OMNIVA.
The buyer bears the delivery costs, and the respective price information is displayed next to the delivery method.
Domestic shipments within Estonia usually arrive at the destination specified by the buyer within 1–2 business days after the sales contract takes effect. Delivery outside of Estonia takes 2–14 calendar days.
In exceptional cases, the Online Store has the right to deliver the goods within up to 45 calendar days.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the Online Store within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day right of return, the ordered goods may only be used to the extent necessary to ascertain the nature, characteristics, and functioning of the goods, as would be allowed in a physical store.
If the goods have been used for purposes other than necessary to determine their nature, characteristics, and functioning, or show signs of use or wear, the Online Store has the right to reduce the refundable amount in accordance with the decrease in the value of the goods.
To return the goods, a withdrawal request must be submitted and sent to the e-mail address kiharhair@gmail.com no later than 14 days after receiving the goods.
The buyer must return the goods within 14 days of submitting the withdrawal request or provide proof that the goods were handed over to the carrier during this period.
Upon receiving the returned goods, the Online Store will refund the buyer without delay, but no later than 14 days from receiving the withdrawal request, all payments received under the contract.
The Online Store may withhold the refund until the item that is the subject of the contract has been returned or the buyer has provided proof of returning the item, whichever occurs first.
If the buyer has explicitly chosen a delivery method different from the cheapest standard delivery method offered by the Online Store, the Online Store is not required to refund the cost that exceeds the standard delivery cost.
The Online Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the Online Store was significantly below the market price due to an error.
Right to File a Complaint
The Online Store is liable for non-conformity or defects in goods sold to the buyer that existed at the time of delivery and become apparent within two years from the delivery of the goods to the buyer. Within the first year after delivery, it is presumed that the defect existed at the time of delivery. It is the Online Store’s responsibility to prove otherwise.
The buyer must notify the Online Store of any defects within two months of discovering them by sending an email to kiharhair@gmail.com.
The Online Store is not responsible for defects that arise after the goods have been delivered to the buyer.
If goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Online Store will refund the buyer all fees associated with the sales contract.
The Online Store will respond to the consumer’s complaint in writing or in a format that allows written reproduction within 15 days.
Direct Marketing and Processing of Personal Data
The Online Store uses the personal data entered by the buyer only to process the order and deliver the goods to the buyer. The Online Store forwards personal data to transport service providers for the purpose of delivering the goods.
The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has explicitly expressed a wish to receive such notifications by providing their email address on the website and indicating consent to receive direct marketing messages.
The buyer can opt out of email offers and newsletters at any time by notifying the Online Store via email or by following the instructions provided in the marketing emails.
Dispute Resolution
If the buyer has any complaints regarding the Online Store, these must be submitted by email to kiharhair@gmail.com.
